End User License Agreement (EULA)

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and eztok.ai ("Company", "We", or "Us") for the use of the eztok.ai software application and related services ("Software" or "Service").

By installing, accessing, or using our Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the Software.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal or commercial purposes in accordance with your subscription plan.

Permitted Uses:

• Create videos for personal or commercial use
• Generate AI content within your subscription limits
• Download and distribute content you create
• Use the Software on devices you own or control

3. Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the Software
• Modify, adapt, or create derivative works of the Software
• Remove or alter any proprietary notices or labels
• Use the Software to create illegal or harmful content
• Attempt to gain unauthorized access to our systems
• Resell, redistribute, or sublicense the Software
• Use the Software beyond your subscription tier limits

4. Data Collection and Analytics

PostHog Analytics Integration: Our Software integrates with PostHog, a third-party analytics platform, to collect usage data and improve our services.

What PostHog Collects:

• Usage Analytics: Feature usage, user interactions, and navigation patterns
• Performance Data: Application performance, error logs, and crash reports
• Device Information: Browser type, operating system, and device specifications
• Session Data: Session duration, page views, and user flows
• Custom Events: Video creation events, subscription activities, and feature adoption

Purpose of Data Collection:

• Improve Software functionality and user experience
• Identify and fix technical issues and bugs
• Analyze feature usage to guide product development
• Optimize performance and loading times
• Understand user behavior to enhance the platform

Data Privacy and Security:

• PostHog data is anonymized and aggregated
• No personally identifiable information (PII) is shared without consent
• Data is encrypted in transit and at rest
• You can opt out of analytics tracking in your account settings
• PostHog complies with GDPR and other privacy regulations

Opt-Out: You may disable analytics tracking at any time through your account settings. This will not affect the core functionality of the Software.

5. Intellectual Property Rights

Your Content:

You retain ownership of all content you create using the Software. However, you grant us a limited license to process, store, and display your content solely to provide the Service.

AI-Generated Content:

Content generated by our AI (including scripts, images, and audio) is provided to you for your use. You may use this content commercially, subject to applicable laws and regulations.

Our Intellectual Property:

The Software, including all AI models, algorithms, user interface, and underlying technology, remains our exclusive property. This EULA does not grant you any rights to our intellectual property except as expressly stated.

6. Third-Party Services

Our Software integrates with various third-party services to provide functionality:

• PostHog: Analytics and user behavior tracking
• Stripe: Payment processing and subscription management
• Supabase: Database and authentication services
• AI Providers: Various AI services for content generation

Your use of these third-party services is subject to their respective terms of service and privacy policies.

7. Subscription and Payment Terms

• Subscriptions are billed in advance (monthly or annually)
• You may cancel your subscription at any time
• No refunds for partial subscription periods unless required by law
• We may modify pricing with 30 days' advance notice
• Failure to pay may result in service suspension or termination

8. Disclaimers and Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or meet your specific requirements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SOFTWARE.

Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

10. Termination

This EULA is effective until terminated. We may terminate this agreement immediately if you breach any terms. Upon termination:

• Your license to use the Software ends immediately
• You must cease all use of the Software
• We may delete your account and associated data
• Provisions regarding intellectual property and liability survive termination

11. Updates and Modifications

We may update the Software and this EULA from time to time. Continued use of the Software after updates constitutes acceptance of the revised terms. We will notify you of material changes via email or through the Software.

12. Governing Law and Disputes

This EULA is governed by applicable laws. Any disputes arising from this agreement will be resolved through binding arbitration, except where prohibited by law.

14. Acknowledgment

By using eztok.ai, you acknowledge that you have read, understood, and agree to be bound by this EULA, including our use of PostHog analytics for service improvement. You also acknowledge that this agreement constitutes the complete and exclusive statement of the agreement between you and eztok.ai.
